Man facing drunk driving charges following fatal accident

On Behalf of | Oct 8, 2020 | DUI

A man in Virginia was recently accused of causing a fatal car wreck due to drunk driving. He is therefore now facing drunk driving charges. However, the man facing charges is still deemed innocent until and unless his guilt is proved in a court of law.

The fatal accident took place at about 11:23 p.m. on Interstate 95. According to authorities, a minivan was driving speedily south along the interstate. All of a sudden, the driver struck the back of a car. Then, both motor vehicles rear-ended a semi-truck.

The 27-year-old minivan driver was transported to a medical center for the treatment of injuries considered to be minor. The car driver was also taken to a medical center with injuries but ended up passing away the following day. The semi-truck driver did not suffer any injuries in the accident. Following the crash, the minivan driver was arrested for driving while intoxicated. He is also facing charges for involuntary manslaughter.

The man facing drunk driving charges in Virginia has a couple of options. The first option is to proceed to trial to fight the charges. At trial, the prosecution must prove the charges beyond a reasonable doubt before a conviction can be handed down. The second option is to try to negotiate a plea agreement with prosecutors, which may lead to lighter charges and thus a more lenient sentence than what may result from a guilty verdict at trial. An attorney can help the defendant to choose the right option given the circumstances surrounding his arrest.
